2/19/2010 6:00:00 AM Letter: It's not a policy until it's written down
This morning I read statements by County Civil Attorney Bob Taylor admitting that the county has no written policy regarding public forum on county property. I thought someone in county government was finally being quoted in print without sticking his foot in his mouth. No such luck.
I went to kdminer.com to view responses to the article, and what should I see? Taylor stating that the county has a policy, it's just not written down. What? He might as well have added that most county residents are idiots. "They will believe what I say."
Listen to some advice, Bob. If it isn't written down, it: 1. didn't happen or, 2. it can't be enforced. I learned this many years ago and it still holds true today. Bob, what happens when a county employee is terminated? Don't you usually cite a policy they violated? What happens if no written county policy is violated? Do you tell them they violated a policy, it's just not written down? I could go on and on, but what's the point? Just this little bit I have written will probably cause some other county official to write some unbelievably inane response. Who will it be this time?
It is really hard to stomach the fact that my tax dollars help fund the government in this county. But there is still hope. As I said, someone will have to defend you, and they too, will stick their foot in their mouth. Brush off your resume, Bob, your time is short.
By the way, I will be suing the county for my last five years' taxes. There is a county law that says if I am not happy with my taxes after five years, I can sue for recovery. Oh, it's a policy all right, it's just not written down. And if you're the attorney for the county ... Hello European Cruise!

Rick: You would have a better chance of taking that cruise if you would blow up an inner tube and set in the Sacramento Wash. Maybe The Watcher can make water for you.

@Guess Who:
Your response should not deter someone from standing up for their rights, even if case law seems to be against them.
The neat thing about case law is that it is very shallow and can evolve to be "more correct" with repeated challenges!

The Watcher
It appears that many of the employed and elected officials of Mohave County are on the fast track to the unemployment line. How is it they can continue to put their big feet into the mouths? They continually let their humming bird butts overload their alligator mouths. The best policy for the county would have been to apologize instead of running their mouths and defaming Luca Zanna in the public forum, but oops that’s right, that policy isn’t written down.
By the way, if anyone sues the county for the tax issues after five years, please make it a class-action adventure so all of us can reap the benefits of the “Yahoos In Mohave County Government” and their unwritten policies they attempt to shove down our throats each and every day.

I had a local attorney claim that he filed an INTENT TO SUE the county (A WRONGFUL DEATH ISSUE)in my behalf in a timely fashion. When it came time to actually file the suit, well all be darn, he had not actualy filed the INTENT TO SUE, so we were up ---- creek. You know who you are! The county got to him. No doubt about it!

The law on this issue does exist. It's case law, and quite a bit of it, that says that a government entity can restrict expressive activity on non public forum property. And nothing in that case law says the restrictions have to be in writing. In fact, if the property is not a traditional public forum, such as a street, park or sidewalk, the government has to do something affirmative to designate it as a public forum.
There would have to be an intentional act, such as inviting the public to use the property as a public forum, or a written policy designating it as a public forum. A uniformally enforced policy of only using the property for official government business would be enforceable regardless of whether its in writting.

I'd love to tell you a true story about a so-called law the does not exist. A "LAW" that got my home and the homes of others taken away. But everytime I try to mention or post it, the miner deletes it or refuses to print it. I don't say anything derogatory... only the truth!

Great article... however, since this is Mohave county, I can not share your enthusiasm.
A few years back, I and several other folks lost their homes, their land, and over 700 acres of Church property. All because of a "LAW" that does NOT exist on paper. In ANY law book, in ANY library ANYWHERE in the state... Only in the mind of the lying lawyer who convinced the so-called judge in BHC that it was so. I confronted judge gurtler as to where he thought I might find that particular "LAW"... since it IS the duty of the judge as a referee in a legal dispute to PROTECT the Rights of BOTH parties.
Well sir, he got so mad at my question, he ruled AGAINST us and the Church right then and there...and we all lost everything we worked for for 25 plus years.
Oh, we had an attorney... another liar. It is my opinion that he, the first liar and the judge all got one of those cruises' you mentioned. OK, maybe NOT to europe.
Good luck Mr. Veradt... If you do sue this county, be sure to include all individuals PERSONALLY... And I Pray you get EVERYTHING THEY own...

One has to find amusement in the looney tunes who threaten to sue, not knowing law suits are not pre-decided events in their favor, decided by a judge, civil jury or both, since judges can nix a suit in the bud with a dismissal! But one can see the looney tunes out in force today writing their "manifestos' hopefully when disappointed and angry at their delusions of grandeur not coming to be, they do not pull a "Austin Texas event on Kingman"!
